El tribunal de alzada acogi\u00f3 los argumentos de la defensa, revocando la condena por contaminaci\u00f3n de aguas y confirmando la absoluci\u00f3n por fraude de subvenciones dictada en el juicio oral, determinando que no existe responsabilidad penal del ejecutivo en los hechos investigados.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">La resoluci\u00f3n de la Corte se fundamenta en criterios jur\u00eddicos que sientan un precedente relevante para la industria acu\u00edcola, tras el exitoso recurso de nulidad interpuesto por los abogados Alejandro Espinoza e Ignacio Sotomayor. Respecto a la supuesta existencia de un delito ambiental, la defensa logr\u00f3 que la Corte estableciera que el art\u00edculo 136 de la Ley General de Pesca exige la acreditaci\u00f3n de un da\u00f1o efectivo a los recursos hidrobiol\u00f3gicos para configurar el il\u00edcito. De esta manera, el tribunal determin\u00f3 que no basta la mera infracci\u00f3n administrativa o la sobreproducci\u00f3n si no existe un impacto ambiental fehacientemente probado en los recursos hidrobiol\u00f3gicos.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Asimismo, la sentencia confirm\u00f3 la tesis de la defensa en cuanto al descarte del fraude de subvenciones, estableciendo que no existi\u00f3 perjuicio fiscal.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cValoramos la sentencia un\u00e1nime de la Corte de Apelaciones de Punta Arenas, que absolvi\u00f3 a don Nicos Nicolaides, ex gerente general de la empresa salmonera Nova Austral, de la acusaci\u00f3n formulada en su contra por el Ministerio P\u00fablico y el CDE, por el delito de fraude de subvenciones de 55.000 millones y delito ambiental\u201d, se\u00f1al\u00f3 el abogado de Nicolaides, Alejandro Espinoza.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Agreg\u00f3 que \u201ceste contundente fallo ratifica la inocencia de don Nicos Nicolaides, estableciendo la inexistencia del delito ambiental imputado y ratifica el fallo del Tribunal Oral de Punta Arenas que absolvi\u00f3 a Nicolaides del delito de fraude de subvenciones, atendido que no se acredit\u00f3 el perjuicio fiscal ni el enga\u00f1o propio de este delito\u201d.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">El equipo legal acredit\u00f3 que las bonificaciones de la Ley Navarino cuestionadas proven\u00edan de ciclos de producci\u00f3n l\u00edcitos y previos a los hechos investigados, descartando as\u00ed cualquier tipo de enga\u00f1o al Fisco. Como consecuencia de este razonamiento, el fallo dej\u00f3 a firme el rechazo \u00edntegro de la demanda civil interpuesta por el Consejo de Defensa del Estado (CDE), la cual ascend\u00eda a los $59.500 millones.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u201cEsta sentencia pone t\u00e9rmino definitivo a este proceso que siempre estimamos infundado, rechazando tambi\u00e9n la demanda civil interpuesta por el fisco\u201d, explic\u00f3 Espinoza.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Respecto a Nicos Nicolaides, quien dej\u00f3 la gerencia general de la compa\u00f1\u00eda en 2019 al inicio de la investigaci\u00f3n, queda tras esta sentencia sin condenas penales vigentes ni obligaciones indemnizatorias.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Para el equipo legal, este fallo es fundamental, ya que entrega certeza jur\u00eddica al sector, al reafirmar que la persecuci\u00f3n penal ambiental exige est\u00e1ndares de prueba rigurosos y no puede basarse \u00fanicamente en faltas de car\u00e1cter reglamentario.<\/span><\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Corte de Apelaciones revoca condena y absuelve de forma un\u00e1nime a exgerente general de Nova Austral tras cinco a\u00f1os de proceso judicial.<\/p>\n","protected":false},"author":10,"featured_media":51094,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[60],"tags":[6936,17386,2331,6518,18751,28450,9152,22510,7388,623],"class_list":["post-84163","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-salmonicultura","tag-acuicultura-chilena","tag-certeza-juridica","tag-consejo-de-defensa-del-estado","tag-corte-de-apelaciones-de-punta-arenas","tag-delitos-ambientales","tag-fraude-de-subvenciones","tag-industria-salmonicultora","tag-justicia-ambiental","tag-ley-general-de-pesca","tag-nova-austral"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
